Partner program terms

These terms apply to anyone promoting Tusk Shells as a partner or affiliate. The program is run by Tusk Shells LLC. Joining the program means accepting them.

1. Who can join

Partners must be 18 or older and apply as themselves. Parents and guardians of people who use pens are welcome to apply, as the partner. We do not run partner accounts for minors. The first run is U.S. only.

2. Commercial terms

Your commission rate, how sales are tracked, the attribution window and when you are paid are agreed with you in writing before you post. Commission is paid on eligible sales only and is reversed on any order that is cancelled, refunded or charged back.

3. Prototype cases

If we send you a prototype to evaluate, it is a pre-production unit. Use it as an everyday carrying case only, follow any instructions we send with it, and keep following your pens' own storage instructions. Do not rely on a prototype as the only way to keep medication cool, and do not describe a prototype's performance as a measured or guaranteed result.

4. Disclosure is mandatory

You must clearly disclose your connection to Tusk in every post, video, story or review that mentions us, including when you received a free case and have no affiliate link or code. The Federal Trade Commission's Endorsement Guides require it, and we require it too.

Put the disclosure in the content itself, not only in a bio, a comment or a block of hashtags, and make it plain and up front. For example: "Tusk sent me this case for free" or "I earn a commission if you buy through my link." "#ad" at the start of a caption is enough for paid posts. In video, say it aloud as well as showing it on screen.

5. What you may say about the product

You may describe what the case is and how it is built: an insulated hard shell, a removable cold rail with two pen channels, gel sealed inside the rail, magnets in the wall and no batteries. You may state the prices on our site and share your own honest experience carrying it.

6. What you may never say

• No hold-time figure other than the one we publish. Until we publish a measured figure, describe 4+ hours only as the design target.
• No claim that it fits every pen. Say it is designed for two standard insulin and GLP-1 pens, and point people to our verified list once it is published.
• No protection claims for hot cars, freezing conditions or air travel. Don't tell anyone it is safe to leave pens in a car, to freeze the rail with pens in it, or that it is approved for flights.
• No medical, health or therapeutic claims, and no claim that it preserves the potency or stability of medication.
• No patent claims. Do not call the case patented or "patent pending".
• No suggestion that the case is a medical device, or is FDA cleared, approved or endorsed.
• No advice about dosing, medication choice or how to store a specific medication.
• No claims about what other partners earn or what you can earn.

If you are unsure whether something is allowed, ask us before you publish it.

7. How you may promote

Not permitted: unsolicited email or direct messages; paid search or bidding on "Tusk", "Tusk Shells" or misspellings; coupon, deal or cashback placements unless we agree in writing; purchased followers or engagement; cookie stuffing; links on sites carrying adult, illegal or infringing material; impersonating Tusk Shells or implying you speak for us; and giveaways in our name without our written agreement.

8. Your application and your data

We use what you send in your application only to review it and run the program, as described in our Privacy policy. Please don't send us health details or anyone's medical information.

9. We monitor, and we will act

We review partner content. If something breaks sections 4, 6 or 7 we will ask you to correct it. If it is not corrected promptly, or if it is serious, we will remove you from the program and withhold unpaid commission on the affected traffic.

10. Brand use

You may use the Tusk Shells name and any assets we supply, as supplied. Do not alter the mark, use it in your own handle, domain or business name, or register anything containing it.

11. The relationship

You are an independent contractor. This is not employment, partnership, agency or a franchise. You are responsible for your own taxes and cannot make any commitment on our behalf.

12. Ending it

Either of us may end the relationship at any time, in writing. Commission already earned on valid orders is paid out; commission on traffic that broke these terms is not. Sections 4, 6, 9 and 10 survive the end of the relationship.

13. Changes

We may update these terms; the date at the top shows when they last changed. Continuing in the program after a change means accepting it.
